Arizona Clarifies Service Requirements for Public Projects

In Cemex Construction Materials South, LLC v. Falcone Bros. & Assoc. Inc., Division Two of the Arizona Court of Appeals decides that Preliminary Twenty-Day Notices being sent pursuant to Arizona’s Little Miller Act must be served via certified mail or registered mail.
Arizona’s Little Miller Act requires a general contractor on a public project to post a bond to ensure that all who supply labor or materials to the project are paid. Both a payment and a performance bond must be posted before public work begins. Arizona’s Little Miller Act applies to most non-federal public works projects. To maintain an action on the bond, a claimant must comply with the notice requirements of ARS § 34-223(A) which require that:
a) the claimant must have a direct contract with a subcontractor of the prime contractor but no contractual relationship, express or implied, with the prime contractor;

2015 Debra Hahn Memorial Award Winner announced!!

The Debra Hahn Memorial Award was created by CFMA’s Executive Committee on July 14, 1991 as a remembrance of Debra Hahn, who died in a plane crash on March 18, 1991. Debra was one of the founders of CFMA’s Charlotte, NC Chapter, a former member of the Board of Directors, and treasurer of the Massachusetts Chapter at the time of her death.

This Memorial Award recognizes outstanding CFMA participation and activity on both the local Chapter and National levels. It is given each year to that CFMA General or Associate Member who exemplifies the following:
Enthusiasm in the promotion of CFMAContribution at the local chapter level (including participation in CFMA functions and committees)Involvement at the National level (including participation in CFMA functions and committees)Activities that support CFMA’s Mission and Strategic GoalsConsideration for, and service to, fellow CFMA membersSignificant years of contributions to CFMA Note that Officers from CFMA or ICCIFP are ineligible for the aw…

2015 Joe Quigley Memorial Award Winner announced!!

On May 17, 1999, CFMA’s Executive Committee unanimously approved the creation of the Joe Quigley Memorial Award in memory of former national president and Valley of the Sun Chapter leader, Joe Quigley. As a remembrance of Joe Quigley, who was a founding member of the Valley of the Sun Chapter and served as its third president. Under his leadership, the Chapter developed its highly successful golf tournament to raise money for college scholarships. Joe’s commitment to local chapter activities, and CFMA in general, epitomizes the dedication and commitment of CFMA volunteers. This Memorial Award recognizes outstanding chapter participation and activity. It's so hot in Arizona that............... Farmers are feeding their chickens crushed ice to keep them from laying hard-boiled eggs. You can say 113 degrees without fainting. You eat hot chilies to cool your mouth off. You can make instant sun tea. You learn that a seat belt makes a pretty good branding iron. The 4 seasons of AZ: tolerable, hot, really hot, and ARE YOU KIDDING ME??!! Its noon in July, kids are on summer vacation, and not one person is out on the streets.
